Defense team of the Ulm 5 demands immediate release from pre-trial detention

We, the defense attorneys of the Ulm 5, have filed an appeal against their remand today. Our clients must be released from pre-trial detention without delay.

Our clients have now been held in continuous pre-trial detention for almost five months. The harsh conditions remain in place. These include strict monitoring of phone calls, visits, and correspondence, confinement in their cells for up to 23 hours a day, and restricted access to books and group activities. The enforcement of pre-trial detention has been disproportionate from the very beginning.

This action was clearly directed toward a legitimate aim: ending the killing of civilians in Gaza. The only thing that occurred here was property damage; no people were harmed. Elbit Systems Deutschland GmbH & Co KG is a wholly owned subsidiary of the Israeli company Elbit Systems Ltd. The latter profits greatly from the war in Gaza and supplies a significant portion of the drones used there. However, there was no investigation into this line of defense based on justifiable emergency response; a request to this effect by the defense was ignored by the Stuttgart Public Prosecutor's Office. The investigating authorities' main concern is clearly making an example of our clients, who are committed to fighting occupation and genocide.

Furthermore, following the filing of charges, the Stuttgart Regional Court is now violating the principle of expedition in detention matters (Art. 5 para. 3 sentence 2 ECHR; §§ 121, 122 StPO). The main trial is scheduled to begin in late April 2026 at the earliest and to last at least until the end of July. However, the court is legally obliged to start the trial no later than early March 2026. The unlawful detention of our clients is thus being prolonged until further notice, which constitutes a further serious violation of their fundamental right to freedom.

This is why today, all defense attorneys have filed appeals against remand in custody with the Stuttgart Higher Regional Court.
